 GENERAL TERMS AND CONDITIONS OF CONTRACTING

Introduction

This contractual document shall govern the General Terms and Conditions of contracting products (hereinafter, "Conditions") through the website ereselegante.com, owned by Cravatta World S.L. under the registered trademark Eres Elegante, hereinafter, the PROVIDER, whose contact details are also available in the Legal Notice of this website.

These Conditions will remain published on the website available to the USER for reproduction and storage as confirmation of the contract and may be modified at any time by Eres Elegante. It is the responsibility of the USER to read them periodically, as the Conditions in force at the time of placing orders will apply. Eres Elegante will archive the electronic document formalizing the purchase and will keep it available to the USER upon request.

Contracts will not be subject to any formality except in cases expressly indicated in the Civil and Commercial Codes and in this or other special laws.

Acceptance of this document means that the USER:

Has read, understands, and comprehends what is set forth herein.

Is a person legally capable to contract. Assumes all obligations set forth herein.

These conditions will have an indefinite validity period and will be applicable to all contracts concluded through the PROVIDER's website.

The PROVIDER informs that the business is responsible for and aware of the current legislation of the countries to which it ships products, and reserves the right to unilaterally modify the conditions, without affecting goods or promotions previously purchased before the modification.

Identity of the contracting parties

On one side, the PROVIDER of the products contracted by the USER is Eres Elegante, a registered trademark owned by Cravatta World, S.L., with corporate address at Calle de Huelva, 52 - 28939 Arroyomolinos (Madrid) - Spain, CIF B87109567 and customer service telephone +34 676 99 22 00.

On the other side, the USER, either a registered user on the website through a username and password or an unregistered user. The registered USER will have full responsibility for the use and custody of their username and password and will be responsible for the accuracy of the personal data provided to the PROVIDER.

Object of the contract

This contract aims to regulate the contractual sales relationship between the PROVIDER and the USER at the moment the USER accepts the corresponding box during the online contracting process.

The contractual sales relationship entails the delivery, in exchange for a set price publicly displayed on the website, of a specific product.

Data correction

When the USER identifies errors in the data published on the website or in documents generated by the contractual relationship, they may notify info@ereselegante.es so that Eres Elegante can correct them as soon as possible.

The USER can keep their data updated by accessing their user account.

Contracting procedure

To access the products or services offered by the PROVIDER, the USER must be of legal age and freely and voluntarily provide the personal data required, which will be processed according to Regulation (EU) 2016/679 of 27 April 2016 (GDPR), concerning the protection of natural persons regarding the processing of personal data and the free movement of such data, and Organic Law 3/2018 of 5 December (LOPDGDD), on personal data protection, detailed in the Legal Notice and Privacy Policy of this website.

The registered USER will select a username and password, committing to diligent use and not to make them available to third parties, and to notify the PROVIDER of any loss or theft or unauthorized access, so the PROVIDER can immediately block the account.

Once the user account is created, according to Article 27 of Law 34/2002 on Information Society Services and Electronic Commerce (LSSICE), the contracting process will follow these steps:

1. General contracting clauses.

2. Order shipment and delivery.

3. Right of withdrawal.

4. Complaints and online dispute resolution.

5. Force majeure.

6. Jurisdiction.

7. General offer details.

8. Price and validity term of the offer.

9. Shipping costs.

10. Payment methods, charges, and discounts.

12. Contract dissociation, suspension, or termination.

1. GENERAL CONTRACTING CLAUSES

Unless otherwise stipulated in writing, placing an order with the PROVIDER implies acceptance by the USER of these legal conditions. No stipulation made by the USER will differ from those of the PROVIDER unless expressly accepted beforehand in writing by the PROVIDER.

2. SHIPMENT AND DELIVERY OF ORDERS

The PROVIDER will not ship any order until payment has been verified.

Shipments will be made through one of the main national or international carriers, depending on the destination freely chosen by the USER.

Shipment will occur once the availability of the merchandise is confirmed and payment verified.

The delivery time will be between 2 and 6 business days, depending on destination and payment method chosen. Estimated shipping and delivery dates will be provided before order confirmation.

Failure to execute the distance contract

If the contract cannot be executed because the product or service is not available within the expected time, the USER will be informed of the lack of availability and will be entitled to cancel the order and receive a full refund at no cost, and no liability for damages will be attributed to the PROVIDER.

In case of unjustified delay by the PROVIDER in refunding the total amount, the USER may demand double the owed amount, without prejudice to other damages compensation.

The PROVIDER will not be liable when delivery is not completed due to false, inaccurate, or incomplete data provided by the USER.

Delivery will be considered complete when the carrier places the products at the USER's disposal and the USER or their delegate signs the delivery receipt.

The PROVIDER will respond to any non-conformity existing at delivery; the USER may require correction, price reduction, or contract termination, and may additionally claim damages if applicable.

The USER is entitled to suspend payment of any outstanding balance until the PROVIDER fulfills their contractual obligations.

It is the USER’s responsibility to verify products upon receipt and to state any justified reservations or complaints on the delivery document.

3. RIGHT OF WITHDRAWAL

The USER has fourteen calendar days from receipt of the product or from the conclusion of the sales contract if it is a service to exercise the right of withdrawal regulated in Article 102 of Royal Legislative Decree 1/2007 of November 16, which approves the consolidated text of the General Law for the Defense of Consumers and Users and other complementary laws, hereafter RDL 1/2007. If the PROVIDER fails to comply with the duty to inform about the right of withdrawal, the period to exercise it will extend twelve months after the expiration of the initial withdrawal period, in accordance with Article 105 of RDL 1/2007.

The right of withdrawal does not apply to contracts listed in Article 103 of RDL 1/2007 and listed here.

Any return must be communicated to the PROVIDER, requesting a return number via the enabled form or by email to info@ereselegante.es, indicating the invoice or order number.

If the return is not made with the original delivery packaging, the PROVIDER may charge the packaging cost to the USER after prior notification by the same communication channel.

Once the USER receives the return number, they will send the product to the PROVIDER, indicating this number on the shipping letter, with shipping costs borne by the USER, to the address: Eres Elegante, Calle de Huelva, 52 - 28939 Arroyomolinos (Madrid) - Spain.

4. COMPLAINTS AND ONLINE DISPUTE RESOLUTION

Online Dispute Resolution (ODR)

In accordance with Art. 14.1 of Regulation (EU) 524/2013, the European Commission provides a free access platform for online dispute resolution between the USER and the PROVIDER, without resorting to courts, through a neutral third party called the Dispute Resolution Body that acts as an intermediary to reach an agreement and may suggest or impose a solution.

5. FORCE MAJEURE

Neither party will be liable for any failure due to force majeure. The fulfillment of obligations will be delayed until the force majeure event ends.

6. JURISDICTION

The USER may not assign, transfer, or transmit the rights, responsibilities, and obligations contracted in the sale.

If any provision hereof is declared null or unenforceable, the validity, legality, and enforceability of the remaining provisions will not be affected.

The USER declares to have read, known, and accepted these Conditions in full.

7. GENERAL OFFER DETAILS

All sales and deliveries by the PROVIDER are subject to these Conditions.

No modification or agreement contrary to the Commercial Proposal of Eres Elegante or these Conditions will have effect unless expressly written and signed by the PROVIDER. Such agreements shall prevail.

8. PRICE AND VALIDITY PERIOD OF THE OFFER

Prices stated for each product or service include VAT or other applicable taxes, unless otherwise stated. Prices do not include shipping, handling, or other additional services unless expressly agreed otherwise.

Prices for each product are published on the website and expressed in EURO. The USER acknowledges that some product prices may vary in real time.

Before purchase, all order details can be checked online: items, quantities, price, availability, shipping costs, charges, discounts, taxes, and total. Prices may change daily until ordering.

Once ordered, prices remain fixed regardless of product availability.

Any payment to the PROVIDER will generate an invoice in the name of the registered USER or the business name provided. This invoice can be downloaded as PDF via the user account panel. If email delivery is preferred, it must be requested; the USER can revoke this at any time.

9. SHIPPING COSTS

Store prices do not include shipping or handling fees unless otherwise expressly agreed.

Shipping costs will be calculated upon saving the cart or quote based on product weight and delivery address.

10. PAYMENT METHODS, CHARGES, AND DISCOUNTS

The PROVIDER is responsible for economic transactions and offers the following payment methods:

Bizum (only in Spain)

Bank Transfer

Cash on Delivery (only in Spain, with a 4% surcharge over the order amount, minimum €3.50 VAT included)

The USER may use a discount coupon before completing the purchase if received from the PROVIDER.

Security Measures

The website uses generally accepted information security techniques such as SSL, secure page data entry, firewalls, access control procedures, and cryptographic mechanisms to prevent unauthorized data access. For these ends, the user/client accepts that the PROVIDER obtains data for access authentication.

The PROVIDER commits not to allow any transaction considered illegal by credit card brands or acquiring banks that could damage their goodwill or reputation.

Sale or offering of products or services not complying with all applicable laws for Buyer, Issuer Bank, Merchant, or Cardholder is prohibited under credit card brand programs.

11. PURCHASE PROCESS

Any product from our catalog can be added to the cart. The cart shows items, quantity, price, and total amount. Taxes, charges, and discounts are calculated after saving the cart based on payment and shipping data provided.

The cart has no administrative binding; it simulates a quotation with no commitment from either party.

Order placement follows these steps for formalization:

1. Billing details verification.

2. Shipping address verification.

3. Payment method selection.

4. Place order (purchase).

After processing, the system sends a confirmation email to the PROVIDER's management and the USER.

Before order confirmation, information on order status and approximate shipping and delivery date will be provided.

12. DISSOCIATION AND SUSPENSION OR TERMINATION OF THE CONTRACT

If any terms are illegal, null, or unenforceable, they shall be severable without affecting remaining conditions.

The PROVIDER may suspend or terminate USER access to services, whole or partially, without prior notice if the USER breaches contract or applicable laws, licenses, regulations, directives, practice codes, or policies.

Exercising rights under this clause does not prejudice the PROVIDER's other rights, powers, or remedies.

13. WARRANTIES AND RETURNS

Warranties comply with the Title "Warranties and after-sales services" of Royal Legislative Decree

1/2007, November 16, approving the consolidated text of the General Law for the Defense of Consumers and Users and complementary laws, accessible here.

14. APPLICABLE LAW AND JURISDICTION

These conditions will be governed and interpreted according to Spanish law where not expressly provided otherwise. Any dispute arising from product or service provision will be submitted to the courts of the PROVIDER's domicile, the place of obligation fulfillment, or where the good is located if immovable.
